A plea on Monday made directly to Missoula Justice of the Peace Landee Holloway by the alleged victim of strangulation and unlawful restraint, allowed 23 year-old Mitchell Obermayer to be placed directly in the custody of pretrial supervision, rather than the $25,000 bail asked for by the State.

Obermayer was placed in the Missoula County Jail on $50,000 bond late Saturday night after allegedly strangling a woman and restraining her from leaving a residence, destroying property, as well as kicking and fighting a sheriff’s deputy who attempted to arrest him.

Court documents state that on Saturday night, June 16, Obermayer had consumed two pints of whiskey and was lying naked on the bathroom floor when Missoula County Sheriff’s deputies arrived at a residence on Lewis and Clark Drive to find a woman outside crying, with redness on her neck indicating the strangulation.

When the deputy asked Obermayer to step outside, he initiated a physical altercation. The deputy was able to get handcuffs on the suspect, but he slipped the cuffs to the front of his body and began to kick at the deputies.

During Obermayer's Missoula Justice Court appearance, the victim told the judge that she fully agreed with the condition that Obermayer not be allowed any access to alcohol. She maintained that Obermayer was not violent and that ‘he will never hurt me again’.

In her instructions to the defendant, Holloway said he must be placed on ‘continuous alcohol monitoring’. This means that Obermayer will be fitted with an ankle bracelet that measures alcohol consumption 24 hours a day, seven days a week.

His next court appearance will be on July 2.
